These Terms and Conditions ("Terms") form a legally binding agreement between West Coast Underground Radio ("WC Underground," "we," "our," "us") and the submitting artist ("Artist," "you").
By registering as an artist and submitting any content, you acknowledge that you have read, understood, and agree to these Terms.
1. Acceptance of Terms
By submitting music, audio, artwork, photos, videos, logos, or any promotional materials ("Submitted Content"), you agree that WC Underground may use, stream, publish, and feature your content on our platforms.
This includes but is not limited to:
- West Coast Underground Radio
- Our website(s)
- Our mobile app(s)
- Social media pages
- Marketing materials
- Livestreams, interviews, and promotional content
You agree these Terms apply immediately upon submission.
2. Ownership of Submitted Content
2.1 Artist Retains All Rights
You affirm and guarantee:
- You own all rights to the music and content you submit, OR
- You have full legal authority to submit it, OR
- You have permission/license from the rights holder(s).
WC Underground does not claim ownership of your music.
3. Permission & License You Grant to WC Underground
3.1 Free, Non-Exclusive License
By submitting content, you grant WC Underground a royalty-free, non-exclusive, worldwide license to:
- Stream your music
- Broadcast your music
- Display your photos and artwork
- Use your name, image, and likeness for promotional purposes
- Feature you in playlists, interviews, posts, or programming
- Store, copy, and transmit the Submitted Content
- Promote your music on social platforms or other media
3.2 Free Submission – No Compensation
You understand and agree that:
- Your participation is 100% voluntary
- You will not be compensated financially
- WC Underground is not required to pay royalties, fees, percentage splits, or any form of compensation
- Your submission is promotional, not contractual employment
4. Artist Responsibilities
You agree that:
- Your submissions do NOT violate copyright, trademarks, privacy, or publicity rights
- Your submissions do NOT contain unauthorized samples
- You are responsible for clearing any rights associated with your music
- You will not submit illegal, harmful, or defamatory content
- You indemnify WC Underground against any legal claims arising from your submissions
5. Content Removal
You may request removal of your music or content at any time by contacting WC Underground through email or our website.
WC Underground may also remove content at its discretion, including for:
- Violations of law
- Copyright claims
- Quality issues
- Failure to follow terms
- Platform changes or restructuring
6. Promotion & Media Use
You authorize WC Underground to use your:
- Artist name
- Stage name
- Social media links
- Album covers
- Photos
- Short bio
- Submitted music
For the purpose of promoting your work or promoting West Coast Underground's brand and broadcasts.
This includes: Stories, Posts, Flyers, Radio drops, Thumbnails, Bumper segments
7. No Partnership or Employment
Submitting your music does not create any:
- Employment relationship
- Partnership
- Agency
- Joint venture
- Royalty agreement
You remain an independent artist retaining all rights to your work.
8. DMCA & Copyright Compliance
If WC Underground receives a DMCA takedown notice involving your content, we may remove the content immediately without prior notice.
You are responsible for resolving any copyright issues directly with the complainant.
9. Liability Disclaimer
WC Underground is not liable for:
- Loss of revenue, royalties, exposure, or opportunities
- Copyright disputes between artists and third parties
- Platform outages or technical issues
- Misuse of your music by external parties
- Removal of your content for legal compliance
You agree to submit content at your own risk.
10. Modification of Terms
WC Underground reserves the right to update or amend these Terms at any time. Continued submission or participation constitutes acceptance of any updated Terms.
11. Governing Law
These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles.
12. Confirmation of Agreement
By checking the box, submitting your music, or completing artist registration, you confirm that:
- You fully understand these Terms
- You agree to all conditions
- You have the legal right to submit your content
- You grant WC Underground permission to feature and promote your content
- You accept that you receive no compensation
- You retain ownership of your music
