These Booking Service Terms and Conditions ("Booking Terms") govern the use of the West Coast Underground Radio Artist Booking Service ("Booking Service"). By opting into this service, artists agree to these terms in addition to the general Artist Terms and Conditions.
1. Service Overview
The Booking Service allows registered artists to receive booking requests from fans, venues, and event organizers for:
- Live performance bookings
- Feature purchases (verses, hooks, or full collaborations)
West Coast Underground Radio ("WC Underground," "we," "our") acts solely as a platform facilitator and is not a party to any agreements between artists and booking parties.
2. Artist Eligibility and Opt-In
2.1 Eligibility Requirements
To participate in the Booking Service, artists must:
- Be registered with West Coast Underground Radio
- Be at least 18 years of age or have parental/guardian consent
- Have the legal right to enter into performance or collaboration agreements
- Maintain an active artist profile on our platform
2.2 Voluntary Participation
Participation in the Booking Service is entirely voluntary. Artists may:
- Opt in or opt out at any time through their artist profile settings
- Choose which types of bookings to accept (performances, features, or both)
- Set their own rates and availability
3. How the Booking Service Works
3.1 For Live Performance Bookings
When a user requests a live performance booking, they must provide:
- Event date and time
- Performance length/duration
- Venue name and complete address
- Offered compensation amount
- Contact information
3.2 For Feature Purchases
When a user requests a feature, they must provide:
- Type of feature requested (verse, hook, or both)
- Upload of their track with open verse/hook sections
- Offered compensation amount
- Desired turnaround time
- Contact information
3.3 Request Delivery
All booking requests are forwarded to:
- The artist's registered email address (if provided during registration)
- West Coast Underground Radio's administrative email (westcoastundergroundradio@gmail.com)
WC Underground will make reasonable efforts to notify artists of booking requests but is not responsible for delivery failures, spam filters, or delayed notifications.
4. Artist Responsibilities
4.1 Response to Booking Requests
Artists who opt into the Booking Service agree to:
- Review booking requests in a timely manner
- Respond to legitimate requests within a reasonable timeframe
- Communicate professionally with potential booking parties
- Honor accepted bookings or provide adequate notice of cancellation
4.2 Direct Negotiations
All negotiations regarding:
- Final compensation amounts
- Performance details and requirements
- Feature specifications and delivery timelines
- Payment methods and schedules
- Contracts and agreements
Must be conducted directly between the artist and the booking party. WC Underground is not involved in these negotiations.
4.3 Legal Compliance
Artists are responsible for:
- Complying with all applicable laws and regulations
- Obtaining necessary permits and licenses for performances
- Paying all applicable taxes on income earned through bookings
- Maintaining appropriate insurance coverage
- Ensuring all delivered content (features) is original or properly licensed
5. Platform Role and Limitations
5.1 Facilitation Only
WC Underground's role is limited to:
- Providing a platform for booking requests
- Forwarding requests to artists
- Displaying booking buttons on artist profiles
5.2 No Involvement in Transactions
WC Underground does NOT:
- Process payments between artists and booking parties
- Verify the legitimacy of booking requests
- Guarantee payment from booking parties
- Mediate disputes between artists and booking parties
- Provide legal or contractual advice
- Act as an agent, manager, or representative of artists
5.3 No Commission or Fees
WC Underground does not charge artists any commission, percentage, or fees for bookings facilitated through the platform. All compensation negotiated between artists and booking parties belongs entirely to the artist.
6. User Responsibilities (Booking Parties)
6.1 Legitimate Requests Only
Users submitting booking requests agree to:
- Provide accurate and complete information
- Have genuine intent to book the artist
- Not submit spam, fraudulent, or harassing requests
- Respect artists' time and professionalism
6.2 Direct Negotiations
Booking parties understand that:
- Offers submitted through the platform are non-binding initial proposals
- Final terms must be negotiated directly with the artist
- Artists may accept, decline, or counter any offer
- WC Underground is not responsible for fulfillment of any agreements
7. Payment and Compensation
7.1 Direct Payment Arrangements
All payment arrangements must be made directly between the artist and booking party. Artists and booking parties are encouraged to:
- Use secure payment methods
- Create written contracts or agreements
- Establish clear payment terms and schedules
- Request deposits for confirmed bookings
7.2 Platform Not Responsible for Payments
WC Underground:
- Does not process, hold, or transfer any payments
- Is not responsible for non-payment or payment disputes
- Cannot enforce payment agreements between parties
- Recommends artists use contracts and secure payment methods
8. Content and File Uploads
8.1 Feature Request Uploads
When booking parties upload tracks for feature requests:
- Files are transmitted to WC Underground's email for forwarding to artists
- WC Underground does not claim any rights to uploaded content
- Booking parties warrant they have rights to the uploaded material
- Files may be deleted after a reasonable period
8.2 Artist Deliverables
For feature purchases, artists are responsible for:
- Delivering content that meets agreed-upon specifications
- Ensuring content is original or properly licensed
- Meeting agreed-upon deadlines
- Providing content in the requested format
9. Cancellations and Disputes
9.1 Cancellation Policy
Cancellation policies are determined by individual artists. WC Underground recommends:
- Artists establish clear cancellation policies in their agreements
- Both parties provide adequate notice for cancellations
- Refund policies be clearly communicated upfront
9.2 Dispute Resolution
WC Underground is not responsible for resolving disputes between artists and booking parties. Parties are encouraged to:
- Communicate directly to resolve issues
- Use written contracts with dispute resolution clauses
- Seek legal counsel if necessary
- Utilize small claims court or mediation services for payment disputes
10. Liability and Disclaimers
10.1 No Warranties
WC Underground provides the Booking Service "as is" without warranties of any kind, including but not limited to:
- Accuracy or reliability of booking requests
- Quality of artists or booking parties
- Successful completion of bookings
- Payment by booking parties
- Performance quality or professionalism
10.2 Limitation of Liability
WC Underground is not liable for:
- Non-payment or payment disputes
- Cancelled or unfulfilled bookings
- Quality of performances or features
- Injuries, damages, or losses arising from bookings
- Fraudulent or misleading booking requests
- Breach of contract between artists and booking parties
- Copyright infringement or intellectual property disputes
- Lost income or business opportunities
10.3 Indemnification
Artists and booking parties agree to indemnify and hold harmless WC Underground from any claims, damages, or expenses arising from:
- Agreements or transactions between parties
- Performance or feature delivery issues
- Payment disputes
- Copyright or intellectual property violations
- Injuries or damages at events
- Breach of these terms
11. Privacy and Data
11.1 Information Collection
Booking requests collect:
- Contact information (name, email, phone)
- Event or feature details
- Uploaded audio files (for feature requests)
- Offer amounts
11.2 Information Use
Collected information is used solely to:
- Forward booking requests to artists
- Facilitate communication between parties
- Maintain records of platform usage
11.3 Information Sharing
Booking request information is shared with:
- The requested artist
- WC Underground administrators
Information is not sold or shared with third parties for marketing purposes.
12. Prohibited Activities
The following activities are strictly prohibited:
- Submitting fraudulent or spam booking requests
- Harassing or threatening artists or booking parties
- Using the service for illegal purposes
- Misrepresenting identity, credentials, or intentions
- Uploading malicious files or content
- Attempting to circumvent or abuse the booking system
- Collecting user data for unauthorized purposes
13. Service Modifications and Termination
13.1 Right to Modify
WC Underground reserves the right to:
- Modify or discontinue the Booking Service at any time
- Update these Booking Terms with notice to users
- Change features, functionality, or requirements
- Limit or restrict access to the service
13.2 Account Termination
WC Underground may suspend or terminate access to the Booking Service for:
- Violation of these terms
- Fraudulent or abusive behavior
- Repeated complaints from users
- Illegal activities
14. Recommendations for Safe Transactions
WC Underground recommends the following best practices:
For Artists:
- Always use written contracts for bookings
- Request deposits before confirming performances
- Verify venue legitimacy before accepting bookings
- Use secure payment methods (PayPal, Venmo, bank transfer)
- Maintain clear communication throughout the booking process
- Set clear expectations for deliverables and timelines
- Consider liability insurance for live performances
For Booking Parties:
- Research artists before making offers
- Create written agreements outlining all terms
- Use secure payment methods with buyer protection
- Communicate expectations clearly
- Verify artist identity and credentials
- Request samples or references when appropriate

If any provision of these Booking Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.
18. Entire Agreement
These Booking Terms, together with the general Artist Terms and Conditions, constitute the entire agreement between artists and WC Underground regarding the Booking Service.
19. Acceptance
By checking the opt-in box for the Booking Service during artist registration or in profile settings, you acknowledge that you have read, understood, and agree to be bound by these Booking Terms.
